Terms and Conditions of Sale – Colmar

Definition

The terms used herein have the meanings given below:

"Client" refers to a natural person of legal age, acting for personal or professional needs and possessing the legal capacity to enter into these terms.
"Hotel" refers to Contact Hôtel du Ladhof (operated by Ladhof SARL, 198 rue du Ladhof, 68000 Colmar, RCS Colmar n° 316 137 769).

"Party"; "Parties" refers to the Client or the Hotel, separately or together.

Application

These Terms and Conditions of Sale (hereinafter referred to as "T&Cs") govern all sales transactions the Hotel makes with the Client.

The Client automatically accepts these T&Cs in full by making a reservation request. Additional specific sales conditions may also apply, as detailed in the service description.

The Hotel reserves the right to refuse to enter into a contract with any Client who violates these T&Cs.

Capacity

The Client confirms that they possess the full legal capacity to accept these Terms and Conditions, indicating they have reached the legal age and are not under any guardianship or curatorship.

Prices and Services

All prices are stated in euros, and each transaction will be conducted in euros. VAT is included in the listed rates. Any changes to the applicable VAT rate will be automatically reflected in the prices at the time of invoicing.

The prices provided apply only to the specific services outlined in the reservation and do not include any additional services the hotel may offer during your stay, such as taxi services, meals, etc., or local tourist taxes, if applicable.

Rates will be considered final only upon confirmation of the reservation. The only contractual price is the one stated in the reservation confirmation from the hotel.

Booking/Modification and Cancellation Terms

As part of their reservation, the Client must provide their contact details along with their banking information.

The reservation becomes firm and definitive only after the Hotel confirms it. This confirmation signifies acceptance of these Terms and Conditions. The Hotel will send the Client a reservation confirmation through any available means.

The Hotel reserves the right to request full payment or a deposit from the Client for specific reservations. Payments can be made by cheque or credit card. Once the payment is received, the reservation will be confirmed. Any additional amounts requested by the Hotel must be paid within the specified time frame.

You can modify your stay up to 72 hours before the scheduled start date. Any modifications must be confirmed by the Hotel. If the Hotel refuses the modification, the cancellation conditions described below may apply.

Cancellation of a stay can be done on-site at Hôtel Restaurant du Ladhof, located at 198 rue du Ladhof, 68000 Colmar. Alternatively, you can cancel by email at hotelduladhof@hotmail.fr or by phone at 0389410978. Please note that the cancellation will only be considered effective once the Client receives a confirmation from the Hotel.

In the absence of a cancellation by the Client and if there is a no-show on the date of the stay, the total amount due under the contract will be charged. No refund will be possible after the invoice has been issued.

Cancellation Conditions

The cancellation conditions are as follows:

  • Deposits are non-refundable, regardless of the circumstances;
  • In case of cancellation within the last 72 hours before the stay, the entire stay will be charged.

Arrival Time – Departure Time – Key Handover

The Hotel kindly asks that the Client schedule their arrival between 5 PM and 9 PM. Arrivals outside of these hours are not permitted. If the Client arrives after this designated time, the reservation will be considered cancelled, and applicable fees will be charged in accordance with these Terms and Conditions.

The Hotel asks that clients plan to depart by 11 AM at the latest. If the room is not vacated by the specified time, the Client may be charged for an additional night.

The keys to the reserved room(s) will be provided to the Client upon arrival. They must be returned by 11 AM on the day of departure. If the keys are not returned, the Hotel may charge the Client for the cost of creating a new key and keyring. Additionally, the Hotel may charge for any nights that the room cannot be rented due to the missing keys.

Responsibilities

The Hotel is not responsible for theft, loss, or damage to Clients' belongings during their stay.

The Client will be held responsible for any damage, degradation, or acts of vandalism that occur during their stay on the premises. In the event of damage to the property, such as theft, destruction of furniture, or any other vandalism, the Hotel may charge the Client fees equal to the cost of repairing the damages. Additionally, the Hotel reserves the right to charge for all nights during which the room cannot be rented due to the damages.

Force Majeure

Force majeure refers to any unforeseen and insurmountable event that occurs outside the control of the parties involved. This event prevents the Hotel or the Client from fully or partially meeting their obligations as outlined in the contract. Examples of such events include strikes, riots, exceptional legal requirements, and insurrections.

It is agreed that in cases of force majeure, the execution of obligations for both parties will be suspended. Each party will bear the costs associated with this suspension. Notably, the client will be responsible for any additional expenses that may arise in order to continue their journey.

Complaints

Any complaints must be submitted within thirty days after the end of your stay. Please address them directly to the hotel at the following address: Hôtel Restaurant du Ladhof, 198 rue du Ladhof, 68000 Colmar. Complaints submitted after this period will not be considered.

Data Protection and Privacy

In accordance with law L.78-the 17 January 1978, concerning computers, files, and freedoms, the Client is informed that the information they provide to the Hotel during the reservation process will be subject to computerized processing unless they explicitly oppose this.

The Client has the right to access, rectify, and delete their entered data, which can be exercised at the Hotel: Hôtel Restaurant du Ladhof, 198 rue du Ladhof, 68000 Colmar.

The Hotel will never use this data for any purpose other than reservations and sales within the Hotel. This information will not be shared with third parties.

The Hotel has a video surveillance system in its parking lot.

Governing Law

These General Terms and Conditions (GTC) are governed by French law.

Any disputes between the Client and the Hotel are governed by French law and belong to the exclusive jurisdiction of French courts.
